Delhi High Court Quashes Rape FIR, Calls It Misuse of Section 376 IPC
The Delhi High Court has recently cancelled a rape case against a man, saying it was a clear misuse of Section 376 of the Indian Penal Code (IPC). The court said this case shows how some people wrongly use serious laws to harass men.
Justice Chandra Dhari Singh said, “It’s true that Section 376 deals with a very serious crime. But it’s also known that some use it as a weapon to trouble men unfairly.”
The FIR was registered in September 2021. The woman had claimed the man sexually harassed her. The man asked the court to cancel the FIR, saying they were in a relationship and had physical relations with each other with mutual consent.
He also said that the woman’s statement to the magistrate did not include any claims that he tricked her into a relationship by promising marriage. As proof, the man shared WhatsApp chats and audio recordings. The prosecution, however, argued that since it was a rape case under Section 376, it should not be canceled.
Despite this, the court allowed the man’s request. It noted that the man wanted to marry the woman, even though his family didn’t agree. But later, the woman lost interest and started a relationship with someone else.
The court also said that the WhatsApp messages showed the woman telling the man she wanted to marry someone else. This made it clear that the FIR was an afterthought.
The court found that all the evidence – the chats, the woman’s statement, and the audio recordings – proved that both people had a consensual relationship. Also, the man didn’t force her or make any false promise of marriage.
So, the court decided that the main conditions for a rape case under Section 376 IPC were not met, and the FIR was quashed.
