Delhi High Court Fines Woman ₹5,000 for False Bias Claim Against Family Court Judge
The Delhi High Court has fined a woman ₹5,000 for making baseless allegations of bias against a family court judge in a child custody case. The Court said the transfer petition was filed on “scandalous grounds” and was an attempt to undermine judicial authority.
Justice Dinesh Kumar Sharma dismissed the plea, noting that if the woman was dissatisfied with the family court’s order, she should have challenged it through proper legal channels instead of accusing the judge of favoritism.
Earlier, the family court had granted the child’s father limited visitation rights, allowing him to meet the child twice a month in a children’s room within the court complex. The mother later accused the father of sexually abusing the child during one such visit and filed a case under the Protection of Children from Sexual Offences (POCSO) Act. However, the father was acquitted in that case.
Following the acquittal, the mother alleged that the family court suggested the father could apply for temporary custody of the child, which she claimed showed bias. Her request to transfer the case to another family court judge was first rejected by the Principal Judge of the Family Courts in Dwarka, who found no evidence of prejudice.
When the matter reached the Delhi High Court, it too found no merit in her arguments. The Court emphasized that unnecessary allegations weaken the credibility of the judiciary and cannot be tolerated.
The High Court therefore dismissed her petition and directed her to deposit ₹5,000 with the Delhi High Court Legal Services Committee within four weeks.
