Delhi High Court Grants Divorce Due to Wife’s Parental Influence and Cruelty
The Delhi High Court recently granted a divorce to a man, citing that his wife was under her parents’ undue influence, preventing a healthy marital relationship. The court ruled that prolonged separation, false complaints, and a lack of conjugal relations amounted to mental cruelty.
Husband Challenges Previous Verdict
The case arose when the husband appealed against a family court decision that had denied his request for divorce. The couple had been living separately for nearly 13 years, during which the husband faced police complaints and was deprived of conjugal relations.
A bench led by Justice Suresh Kumar Kait found evidence of excessive parental interference in the wife’s marital life. The court stated that the wife failed to maintain an independent marital bond with her husband, which constituted mental cruelty.
Lack of Conjugal Relations and False Allegations
The court stressed that conjugal relations are essential for a successful marriage. The wife’s refusal to reconnect and the long separation proved that the relationship was beyond repair. Additionally, the court condemned the false complaints filed against the husband and his family, calling them a clear form of mental cruelty.
Citing the Supreme Court case Samar Ghosh v. Jaya Ghosh (2007), the court ruled that depriving a spouse of companionship over an extended period is an act of extreme cruelty.
Final Judgment
Given the irreconcilable differences, false allegations, and prolonged separation, the court ruled that there was no hope for reconciliation. The marriage had completely broken down, leading to a loss of faith, trust, and affection.
The Delhi High Court overturned the previous verdict and granted the divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1955. The court concluded that continuing such a relationship would only cause further cruelty to both parties.
