The Delhi High Court recently ruled that constant verbal abuse by a wife towards her husband and his family qualifies as cruelty, making it a valid ground for divorce under the Hindu Marriage Act.

Court’s Observation

A family court had earlier granted a divorce decree in favor of the husband, which was challenged by the wife. A bench of Justices Sanjeev Sachdeva and Vikas Mahajan upheld the decision, stating that:

“No person can be expected to live with constant abuse being hurled upon him.”

The court found that the wife’s repeated use of insulting and humiliating language caused significant mental agony and suffering for the husband.

Wife’s Claims Dismissed

  • The wife alleged that her husband was having an extra-marital affair, but the court found no substantial evidence.
  • She also argued that specific dates and times of the abuse were not mentioned, but the court ruled that the repeated nature of the cruelty made exact timestamps unnecessary.

Final Verdict

The court emphasized that every individual has the right to live with dignity and that persistent insults constitute mental cruelty. As a result, the wife’s appeal was dismissed, and the divorce was upheld.

This case highlights the importance of mutual respect in marriage and sets a precedent for handling cases of verbal abuse in matrimonial disputes.
