Delhi High Court Dissolves Marriage After Wife Files False Criminal Complaint Against Husband

The Delhi High Court has dissolved the marriage of a Hindu couple, citing that the wife filed a false criminal complaint against her husband, which caused him severe mental distress and anguish. The judgment was delivered by a bench of Justices Vipin Sanghi and Jasmeet Singh on Saturday.

The court observed that the false allegations made by the wife amounted to a “clear and categorical character assassination” of both the husband and his family. The bench highlighted the significant mental harassment the husband endured, having to visit the police station 30 to 40 times due to the complaint. The court noted that each visit must have been traumatic, with the constant fear of being arrested looming over him.

The court further stated that the wife’s unproven criminal complaint caused immense mental cruelty to the husband and his family, leading the court to grant the husband’s request for divorce. The couple had been married since May 2008, but the wife left the matrimonial home after two years. Nearly three years into the marriage, she filed a complaint with the Crime Against Women (CAW) cell, accusing the husband and his family of dowry demands, abuse, and other forms of cruelty. However, all these allegations remained unsubstantiated.
