Delhi High Court Denies Bail to Woman’s Mother and Grandmother for Assaulting Her Husband

Delhi HC Refuses Bail to Woman’s Mother and Grandmother in Husband Assault Case

The Delhi High Court has denied bail to a woman’s mother and grandmother, who were accused of abducting and attacking her husband after the couple married without family approval.

According to the case details, a man named Raman married Menka without their families’ consent. After their wedding on December 22, 2021, the couple returned to Delhi. Menka’s family allegedly threatened to kill Raman.

While returning from submitting a protection request at the Rajouri Garden police station, the couple was attacked by Menka’s brothers and uncles, who then forcibly took them to their house in Sagarpur.

As per the police, Menka’s 86-year-old grandmother Kaushalya encouraged family members to mutilate Raman, saying he deserved no mercy. Shockingly, 42 criminal cases were already registered against her.

Menka’s mother Geeta was also accused of physically attacking Raman and was declared a proclaimed offender earlier in the case.

The third accused, Menka’s sister Naina Rana, was also part of the bail plea. However, the court found no active role played by her and granted her bail.

But for Geeta and Kaushalya, the court observed that the charges were serious, involving violent assault and instigation of brutal acts. Their criminal backgrounds further weakened their bail request.

Justice Anoop Kumar Mendiratta said that when couples marry legally, police must act quickly and sensitively to ensure their safety. He added that the police failed to take proper action when the couple filed their complaint.

The judge criticized the SHO of Rajouri Garden Police Station for not protecting the victims and called the police’s behavior unacceptable.

The court also directed that a copy of the judgment be sent to the Delhi Police Commissioner to take corrective action and train police on how to handle such sensitive cases within four weeks.
