Delhi High Court Orders ₹50,000 Compensation for Man Detained Illegally by Police for Half an Hour
The Delhi High Court has ordered two police officers to pay ₹50,000 as compensation to a man named Pankaj Kumar Sharma, who was illegally detained for about 30 minutes without proper legal process.
According to the case, a complaint was received about a knife attack on a woman. A sub-inspector went to the location and found the petitioner, Sharma, with a woman. He was taken to the police station and kept in a lock-up from 11:01 pm to 11:24 pm. Sharma claimed that no FIR or Daily Diary entry was made, and there was no formal arrest.
Justice Subramonium Prasad said that even short detentions without legal procedure are a violation of rights. He strongly criticized the police for acting without any reason and without following the law.
“The man wasn’t even arrested. He was just picked up and locked up with no explanation. This is a serious misuse of power and a clear violation of basic rights,” the court said.
The judge added that simply giving a mild punishment like a warning or censure wouldn’t be enough. The penalty must be strong enough to deter other officers from doing the same.
The court made it clear that even though the detention lasted only 30 minutes, it still violated the man’s fundamental rights. It ordered that the ₹50,000 compensation be paid from the salaries of Sub-Inspectors Rajeev Gautam and Shamim Khan.
