A Delhi court has directed the police to file an FIR against a woman and her father for making false allegations of gang rape, cruelty, and wrongful confinement against her husband and his family. The court passed the order in response to a case where a complaint was filed in 2014, accusing the husband, father-in-law, and sister-in-law of demanding dowry, physical abuse, and gang rape.
The woman’s father initially filed the complaint, claiming that his daughter was subjected to dowry harassment and physical torture by her husband and in-laws. Additionally, the woman accused her father-in-law and sister-in-law of gang rape.
Judge Aanchal, who passed the order, emphasized that while rape is a severe crime, false allegations must also be treated seriously. The judge pointed out that such accusations cause immense humiliation and can isolate the accused and their families from society.
The court acquitted the husband and his family, stating that the prosecution had failed to prove any of the charges. The husband faced charges under sections 498A (cruelty), 342 (wrongful confinement), 323 (hurt), 406 (criminal breach of trust), and 506 (criminal intimidation), while the father-in-law and sister-in-law were additionally charged under section 376D (gang rape) of the Indian Penal Code (IPC).
After the acquittal, the court ordered the SHO of Janakpuri police station to file an FIR under section 211 of the IPC (false charge of offense made with intent to injure) against the woman and her father within 24 hours of receiving the judgment. The police were instructed to submit a detailed report on the investigation within three months.
The court also noted that both the woman, who had graduated as a law student during the trial, and her father, an advocate, displayed a lack of integrity by fabricating stories. Their actions, the court added, went beyond exaggeration and constituted a serious offense of making false charges, punishable by imprisonment.
This case serves as a reminder that while victims of serious crimes like rape deserve justice, false allegations must be met with strict legal consequences to maintain the integrity of the justice system.
