A Delhi court has discharged a man accused of rape after finding that WhatsApp chats between him and the complainant contradicted her allegations. The court said the messages showed a friendly and intimate relationship, making the claims of forcible sexual intercourse highly improbable.
The woman had alleged that the accused raped her inside a car parked near Sarojini Nagar Market, later convincing her not to complain by promising marriage. However, the court observed that such an act in a public place without being noticed seemed unlikely.
The court highlighted one key WhatsApp message from the woman sent soon after the alleged incident: “kuch mat sochna” (don’t think anything wrong). The judge noted that such a message immediately after the alleged assault was inconsistent with the claim of rape.
It also pointed out that the woman filed her FIR nearly five months after the incident, which weakened her credibility. The court remarked that she was an educated and mature woman, making it improbable that she would choose marriage over reporting a serious crime.
During the hearing, the defence argued that the two were in a consensual relationship without any promise of marriage and that the FIR was filed to pressure the accused into marrying her.
The court concluded that the oral allegations were not supported by the electronic evidence and therefore acquitted the man, ruling that Section 125 CrPC allows courts to weigh prosecution evidence even at the stage of framing charges.
