Daughter Not Entitled to Claim Expenses from Father If She Chooses to Break Relationship: Supreme Court

In a significant ruling, the Supreme Court of India decided that a major daughter is not entitled to claim any expenses for her education or marriage from her father if she chooses not to maintain a relationship with him. This judgment came in the context of a divorce case where the court granted the separation based on the irretrievable breakdown of the marriage.

Court’s Ruling on Daughter’s Claims

The court clarified that although the daughter has the right to choose her own path, she cannot demand financial support from her father if she does not wish to engage with him. The bench observed that the daughter, who is about 20 years old, had made it clear that she did not want to maintain any relationship with her father. As a result, she was not entitled to claim any expenses for her education or marriage from him.

Permanent Alimony to the Wife

In the same case, the court also dealt with the financial support of the wife. It fixed a permanent alimony of Rs. 10,00,000 for her, ensuring she has enough funds to support herself and, if desired, her daughter. The court stated that even though the daughter was not entitled to financial assistance from her father, it would ensure that the mother has adequate funds to support her daughter if she chooses to do so.

Mediation and Court’s Observations

Earlier in the case, the court had made it a condition that the divorce would be granted only if the husband agreed to pay for his daughter’s education. However, when the two parties were made to meet in the court’s mediation center, the interaction turned unpleasant. The court then emphasized that for the daughter to expect financial support from her father, she would need to show willingness to maintain some form of relationship with him.

This ruling serves as a reminder that financial obligations between parents and children are linked to the willingness to maintain familial relationships.
