Allahabad High Court Quashes Cruelty Case, Says Dispute Was Over Sexual Incompatibility

The Allahabad High Court has dismissed a case of cruelty filed by a wife against her husband, saying the main issue between them was sexual incompatibility, not actual abuse or dowry harassment.

The couple had married in 2015. The wife later accused her husband and his family of demanding dowry and mistreating her when their demands were not met. She also claimed her husband was addicted to alcohol and forced her into unnatural sexual acts. According to her, he watched adult movies, behaved inappropriately in front of her, and once tried to strangle her when she resisted.

She said her husband left for Singapore and abandoned her in India. When she joined him eight months later, she claimed the abuse continued.

Following these allegations, an FIR was filed against the husband and his family under Sections 498A, 323, 504, 506, and 509 of the Indian Penal Code, along with Sections 3 and 4 of the Dowry Prohibition Act.

In response, the husband and his family approached the High Court asking for the case to be quashed.

After reviewing the case, the court observed that the wife’s claims were vague and lacked specific details. It said that there was no medical evidence of injury and no clear proof of dowry demands made by any individual. The Court noted that the FIR and the victim’s statement did not show actual cruelty as per Section 498A of the IPC.

Justice Anish Kumar Gupta, who heard the case, concluded that the real issue between the couple was their sexual differences. The court said the FIR appeared to have been filed because the wife refused to meet the husband’s sexual needs, not because of cruelty or dowry.

The court ruled that general and unclear allegations cannot form a strong legal case and dismissed the matter.
