Gujarat High Court Awards Rs 1 Lakh Compensation to Man Wrongly Jailed for 3 Years
The Gujarat High Court has ordered the state to pay Rs 1 lakh compensation to Chandanji Thakor, a 27-year-old man who spent 3 years in jail despite being granted bail. The oversight occurred because jail authorities failed to notice the email containing his bail order.
A division bench of Justice AS Supehia and Justice MR Mengdey issued the order after Thakor filed a fresh application. The court had earlier instructed the jail authorities via email about Thakor’s bail, but no action was taken due to the COVID-19 pandemic. Authorities claimed they couldn’t open the email attachment.
The District Sessions Court also received the bail order email but made no effort to ensure Thakor’s release. Consequently, Thakor remained in jail despite his bail being granted on September 29, 2020.
Thakor, serving a life sentence for murder, should have been released after his sentence was suspended. However, due to negligence by the jail authorities and the District Legal Services Authority (DLSA), he continued to be imprisoned.
The court criticized the jail authorities for their lack of attention and directed the state to pay the compensation within 14 days for this “serious lapse.” The court also instructed all DLSAs to gather data on prisoners granted bail but not yet released.
