The Calcutta High Court recently ruled in favor of granting custody of a four-year-old girl to her biological father, overturning a previous decision that had placed the child under the care of her deceased mother’s friend. The case stems from the tragic events of March 7, 2018, when the child’s mother took her own life. Following this, the child’s father was arrested in connection with the suicide.
Initially, the child was placed under the care of her maternal grandmother, Kajal Saha. However, during the legal proceedings, the grandmother also committed suicide. This led to the child being placed in the custody of Julie Roy, a neighbor and distant relative of the child’s mother.
In a recent development, the court decided to transfer custody to the child’s biological father, relying on the report of a clinical psychologist who interacted directly with the child. The court had initially denied the father’s request for custody, allowing the child to remain under the care of her deceased mother’s friend while granting the father visitation rights.
However, a bench comprising Justice Ajoy Kumar Mukherjee and Justice Soumen Sen ruled that Julie Roy was unfit to continue as the child’s guardian. The court noted that Roy lacked the financial resources and capability to provide proper care and education for the child. Additionally, she has her own family responsibilities, including a grown-up son.
In contrast, the court observed that the biological father, an engineer with a stable financial background, had developed a strong bond with his daughter. The judges stated, “We believe that Julie Roy is not suitable to be the child’s guardian. She does not have the financial means or the ability to care for and educate the child. On the other hand, the father is financially secure and has shown affection for his daughter. The bond between the father and the child is growing, and we do not wish to disrupt this.”
