During a hearing for a matrimonial dispute case transfer, Chief Justice of India DY Chandrachud advised a couple to consider divorce by mutual consent, highlighting that a long legal battle would only benefit lawyers and delay resolution.
The Chief Justice questioned the woman about her educational background. When she revealed that she holds an MTech degree and a PhD from a US university but is currently not working, the Chief Justice responded, “You are highly educated, yet you do not have a job. You must find a job for yourself.”
Encouraging the couple to think about mutual consent divorce, the Chief Justice pointed out the lengthy and costly nature of prolonged legal fights. “You could spend 10 years fighting this case, and only the lawyers would benefit. Why not be reasonable and agree to a mutual consent divorce? Otherwise, criminal complaints and other issues may arise. We can close the cases if you both agree to divorce by mutual consent.”
Acknowledging that the relationship had irreparably broken down, the Chief Justice added, “It’s clear you cannot return to each other. If you were uneducated or illiterate, it would be a different situation. But given your qualifications, you can get a job and move forward.”
