Calcutta High Court Advises Adolescents to Protect Dignity and Control Urges
The Calcutta High Court has given important advice to adolescent boys and girls, emphasizing the need to protect their dignity, self-worth, and bodily autonomy. The guidance was issued while acquitting a young man who was sentenced to 20 years in prison under the POCSO Act for engaging in a relationship with a minor.
Court Acknowledges Legal Gaps in POCSO Act
A division bench of Justices Chitta Ranjan Dash and Partha Sarathi Sen recognized that the POCSO Act does not differentiate between consensual, non-exploitative sexual relations among minors aged 16-18 years. Quoting a principle from the Mahabharata, “Dharmo Rakshyati Rakshyita” (one who protects the law is protected by the law), the Court laid down certain responsibilities for adolescents.
Responsibilities of Adolescents
The Court outlined specific duties for adolescent girls:
- Protect their bodily integrity, dignity, and self-worth.
- Strive for self-development beyond gender barriers.
- Exercise control over sexual urges to prevent social disadvantages.
- Safeguard their autonomy and privacy.
Male adolescents were advised to respect these rights and to develop a mindset that upholds a woman’s dignity, self-worth, privacy, and autonomy.
Need for Sex Education
The Court acknowledged that while sexual attraction is natural in adolescence, sexual urges are influenced by individual actions. It stressed that sex education should start at home and be part of the school curriculum, covering topics like reproductive health and hygiene.
The Court concluded that adolescents should focus on their personal growth and career ambitions, stating that relationships and sexual experiences should come naturally when they become independent and mature.
This judgment highlights the importance of responsible behavior, education, and respect in shaping a better future for young individuals.
