The Bombay High Court ruled that a woman should not have to choose between her career and her child, allowing her to relocate to Poland with her daughter after securing a job there.
Justice Bharati Dangre overturned a lower court’s decision that restricted the woman’s travel, highlighting the importance of a woman’s right to professional growth. The woman had filed a petition under the Guardian and Wards Act in a Pune family court, seeking to be declared the sole guardian of her daughter and to relocate to Poland for a job opportunity.
She also requested that her husband provide a no-objection certificate to complete their daughter’s visa process. However, the family court denied her request, preventing her from leaving the country while the guardianship case was ongoing.
The woman challenged this decision in the High Court. Justice Dangre considered both the mother’s right to her career and the father’s right to spend time with his daughter before making the final decision.
The court acknowledged the importance of a father-daughter relationship, stating that while the child is abroad, the father should have overnight access to his daughter during her three vacations each year. This arrangement ensures that the quality of time spent between the father and daughter remains meaningful.
