Bombay High Court Grants Bail to 22-Year-Old Student in Rape Case

The Bombay High Court recently granted bail to a 22-year-old college student who was arrested for allegedly sexually assaulting a woman. The court noted that the FIR was filed based on the advice of the woman’s ex-boyfriend.

Case Background

Justice Makarand S Karnik heard the student’s bail plea on August 22. According to the FIR registered in April 2022, the woman was in a relationship with the student’s friend but later broke up with him.

After the breakup, she started talking to the student, who allegedly tried to reconcile her with her ex-boyfriend. As per the FIR, the student invited her to a lodge, where he allegedly sexually assaulted her.

Court’s Observations

The student’s lawyer, Advocate Pankaj D Purway, pointed out that the FIR was lodged two days after the alleged incident. The Mumbai Police opposed the bail plea, arguing that the accused took advantage of the breakup and committed a serious offense.

However, after reviewing the woman’s statement and WhatsApp messages between her and the accused, Justice Karnik observed that the possibility of a consensual relationship could not be ruled out.

The court also noted that the student had been in custody for over a year and four months, the investigation was complete, and the chargesheet had been filed.

Bail Granted

Considering these factors, the court granted bail to the student, stating that he is a young student who can be released. He was ordered to furnish a personal bond of ₹25,000 and provide sureties of the same amount.

This ruling highlights the importance of evaluating all aspects of a case, including communication records and delays in filing complaints, before determining legal outcomes.
