Bombay High Court Drama: Child Refuses Father’s Custody After 11-Year-Old Court Battle
A dramatic scene unfolded at the Bombay High Court when an 11-year-old child vehemently refused to accompany his father, despite a court order directing his maternal relatives to hand over custody.
The court had previously ruled in favor of the father’s custody petition in February 2022, a decision upheld by the Supreme Court in September 2022. However, compliance with the court order remained elusive, prompting the father to file a contempt of court petition.
Tensions escalated when, upon attempting to take custody of his son, the father faced resistance from the child, who broke free and ran back into the High Court building. A scuffle ensued between the father and the child’s maternal relatives, further complicating the already contentious situation.
The bench of Justices AS Gadkari and PD Naik took a stern stance, castigating the lawyer representing the maternal relatives for overreaching the court’s orders. Despite offers to present video evidence, the bench refused, emphasizing strict adherence to its directives.
Finally, the court mandated the immediate handover of the minor to the father at the Kasturba Marg police station by 7 pm. The father’s plea for a more convenient location was dismissed, underscoring the court’s firm stance on order compliance.
