The Bombay High Court has quashed a rape FIR after the accused and the victim, a 25-year-old woman, got married in Raigad. The woman, who initially filed the complaint, later submitted an affidavit requesting to drop the charges, stating that the issue had been resolved.
Advocate Ganesh Gupta, representing the accused, pointed out that the woman stated her relationship with the accused was consensual, and the FIR was filed due to a misunderstanding. The woman mentioned that she had been friends with the man for several years and that they had been in a consensual physical relationship since 2019.
Initially, the woman’s complaint alleged that the man had made false promises of marriage and engaged in sexual relations with her since 2017, but later refused to marry her. The FIR was lodged on January 2, 2021, at Tilak Nagar Police Station in Mumbai. The accused faced charges under multiple sections of the Indian Penal Code (IPC), including Section 376 (rape), Section 504 (intentional insult), Section 506 (criminal intimidation), Section 376(N), and Section 67A of the Information Technology Act. There were also allegations that the man had shared an obscene video of the woman with her family members.
However, following the filing of the FIR, the couple resolved their differences, got married, and are now parents to a six-month-old son. Advocate Nazneen Khatri, representing the man, stated that the couple is happily married, and the woman no longer wishes to pursue the case.
