The Bombay High Court recently quashed a rape case on the condition that the accused and the alleged victim perform social service for six months.
Justice Prasanna B. Varale and Justice S. M. Modak directed both parties to obtain certificates from the respective institutions confirming satisfactory community service for six months.
The case began with a complaint filed by the alleged victim in March 2020. However, in February 2022, she filed a No Objection Certificate (NOC) affidavit, stating that the complaint was due to compatibility issues and misunderstandings between her and the accused.
In her affidavit, she explained that they had considered marriage and developed romantic feelings, which led to sexual encounters. Over time, she realized they were incompatible and decided to end the relationship. This caused a dispute, during which the accused showed intimate pictures to her family, prompting her to file the FIR in anger.
Later, the alleged victim married someone else and moved on with her life. Both parties agreed to resolve their disputes and requested the Court to quash the FIR.
Considering these facts, the Court agreed to quash the case. The accused is required to perform social services every second and fourth Saturday of each month for six months at Baal Welfare Children Trust in Chembur. The alleged victim must perform similar services at Maru Ghal in Gorai, Borivali (W).
