Bihar Judge Approaches Supreme Court Over Suspension for Speedy Judgments
In an unusual case, a district judge from Bihar, S K Rai, has approached the Supreme Court, claiming he was suspended by the Patna High Court for delivering speedy judgments. The suspension followed his completion of two POCSO case trials within one day and four days, respectively, resulting in life and death sentences.
On July 27, senior advocate Vikas Singh, representing Judge Rai, requested Chief Justice N V Ramana to list the petition early, citing the suspension for swift justice delivery. However, the petition’s details suggest that Rai’s suspension may involve other factors.
Judge Rai joined Bihar Judicial Services as a civil judge (junior division) in 2007, ranking 7th among 318 candidates. While serving in Jehanabad, he was considered for promotion to civil judge (senior division) but was initially denied promotion by the High Court, allegedly due to concerns about his judgment writing.
Despite this, he was promoted to civil judge (senior division) the following year, based on the same judgments previously reviewed. In 2018-19, his judgments led to his promotion to district judge.
In December 2020, Judge Rai requested the High Court to retroactively consider his promotion to civil judge (senior division) in 2013-14 instead of 2014-15. He argued that the delay had made him junior to his batchmates and even those initially junior to him. The High Court rejected his representation in September last year and issued a show-cause notice, questioning his allegations of bias and impartiality in the evaluation process.
This case highlights the challenges within the Indian judicial system, where speedy justice is often hampered by administrative and evaluative hurdles.
