Supreme Court Encourages Bengaluru Couple Seeking Divorce to Reconsider

Recently, the Supreme Court advised a Bengaluru couple seeking divorce to give their marriage a second chance, noting that their busy schedules as software engineers left them little time for each other.

Court’s Advice

Justices K M Joseph and B V Nagarathna expressed concern, saying, “Where is the time for marriage? Both of you are software engineers in Bengaluru. One works during the day and the other at night. You have no regret for divorce but regret for marriage. Why don’t you give a second chance to the marriage?”

Justice Nagarathna added that divorces are not very common in Bengaluru, suggesting the couple could attempt to reconcile.

Settlement Agreement

Despite the court’s advice, the couple’s lawyers informed the bench that during the petition, they were referred to the Supreme Court Mediation Centre to explore a settlement. The couple agreed to dissolve their marriage by mutual consent under Section 13B of the Hindu Marriage Act, 1955, with specific terms and conditions.

One key term of the settlement was that the husband would pay ₹12.51 lakh as a full and final settlement for all monetary claims by the wife as permanent alimony.

Court’s Decision

The Supreme Court acknowledged the couple’s agreement to settle their disputes amicably and approved the terms of their settlement, finding them lawful. The court exercised its power under Article 142 of the Constitution to dissolve the marriage by a decree of divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955.

The court also recorded that the husband had paid ₹12.51 lakh to the wife, who confirmed the receipt of the amount. Additionally, the court quashed other legal proceedings filed by both parties in Rajasthan and Lucknow under the Dowry Prohibition Act, Domestic Violence Act, and other related cases.
