The Bombay High Court has granted bail to a man accused of rape, with a condition that he must marry the survivor if she is found within a year. The court was informed that the survivor, who is currently untraceable, had reported the crime in 2019, stating the relationship was consensual.
The accused, Chetan Chandrakant Tambatkar, expressed his willingness to marry the woman and accept the paternity of the child born from their relationship. The court noted that the woman was of legal age when the incident occurred and had acknowledged the consensual nature of their relationship.
However, the public prosecutor mentioned that the woman is untraceable and the child has already been placed for adoption after being admitted to a childcare center. Justice Bharati Dangre stated in her order that if the survivor is found within a year, the accused should marry her. After a year, he will not be bound by this condition.
The accused and the woman had entered into a relationship in 2018 with plans to marry. However, when the woman became pregnant, the accused allegedly avoided contact, leading her to file a rape and cheating complaint. Following this, the woman gave birth in secret and abandoned the child, leading to her fleeing from authorities.
The court granted bail to the accused on a ₹25,000 bond, with the condition that he will marry the woman if she is found within a year.
