The Supreme Court has stated that convicts who have completed 10 years of their sentence should be granted bail if their appeals are not going to be heard soon. This recommendation was made by a bench consisting of Justices SK Kaul and Abhay Sreenivas Oka while hearing multiple cases from life convicts whose appeals are pending in various High Courts.
The court outlined two key steps in such situations: first, granting bail to convicts who have served 10 years unless there are specific reasons to deny bail; second, considering the premature release of convicts who have served 14 years, regardless of whether their appeals are pending.
Addressing the issue of overcrowded jails, the court stressed the need to take immediate action. The High Courts and State Legal Services Committees have been given four months to identify eligible convicts and ensure compliance. The case is scheduled for review in the last week of January 2023.
The Supreme Court clarified that these directives will apply to all other High Courts in a similar manner.
