In a significant ruling, the Bombay High Court granted anticipatory bail to a husband accused of dowry harassment by his wife under Section 498A of the Indian Penal Code and the Dowry Prohibition Act. The wife had filed a complaint in December 2021, claiming that her husband’s family demanded a gold coin for each family member during their 2017 marriage. When the demand was not met, she alleged that she was harassed.
Following her complaint, a First Information Report (FIR) was lodged against the husband. In response, the husband made counter-allegations. After hearing both sides, the court determined that arresting the husband would not resolve the ongoing conflict between the couple.
While granting bail, Justice SV Kotwal made an interesting observation, stating that “marriages are not made in heaven, they are made in hell.” This remark highlighted the court’s view of the strained relationship between the couple, marked by constant arguments and disputes.
The court directed that if the husband is arrested, he should be released on bail after submitting a bond of Rs. 30,000 with one or more sureties.
This case underscores the complexity of matrimonial disputes and the court’s approach to ensuring a fair resolution while maintaining the rights of both parties involved.
