In a recent ruling, the High Court granted anticipatory bail to a husband accused under Section 498A and the Dowry Prohibition Act. The wife had filed a complaint in December 2021, alleging that her husband’s family demanded a gold coin for each member after their marriage in 2017. When the demand was not fulfilled, she claimed she faced harassment.
Following the complaint, an FIR was lodged against the husband, who then made counter-allegations against his wife. After reviewing the arguments from both sides, the court decided that taking the husband into custody would not solve the problem.
Justice SV Kotwal, a single-judge on the case, granted anticipatory bail to the husband. He noted that the couple was engaged in constant disputes, suggesting that custody wouldn’t lead to a resolution. During the hearing, Justice Kotwal commented, “Marriages are not made in heaven; they are made in hell,” highlighting the troubled nature of the relationship.
The court ordered that if the husband is arrested, he should be released on bail upon providing a bail bond of Rs. 30,000 with one or more sureties.
