Allahabad High Court Grants Bail to Man Accused of Rape, Says Victim Was Aware of Her Actions
The Allahabad High Court has granted bail to a man accused of rape. The court said that the victim “invited trouble herself” by choosing to go to the accused’s house after drinking alcohol with friends.
Justice Sanjay Kumar Singh, who gave the order on March 11, said that the victim, a Master’s student, was educated enough to understand the consequences of her actions. The incident happened on September 21, 2024.
After reviewing the case, the court noted that both the accused and the woman were adults. It also said that the woman had admitted in the FIR (police complaint) that she had gone to a bar with her friends, drank alcohol, and felt unwell. She said she agreed to go to the accused’s house to rest.
According to her complaint, instead of taking her to his house in Noida, the accused took her to a relative’s home in Gurgaon and raped her twice. She also said he touched her inappropriately on the way.
The accused’s lawyer argued that, based on the victim’s own words, it appeared to be a case of a consensual relationship and not rape. The lawyer also mentioned that the accused had been in jail since December 2024, had no past criminal record, and would follow all bail conditions.
While giving bail, the court said that even if the victim’s claims were true, she was responsible for her own choices. It added that her medical report showed a torn hymen but did not confirm rape.
This ruling has sparked public debate over how courts interpret consent, responsibility, and victim behavior in sensitive cases like rape.
