Allahabad High Court Denies Protection to Live-In Couple Due to Woman’s Existing Marriage

The Allahabad High Court recently denied protection to a live-in couple, citing the fact that the woman was already married to another man, and their cohabitation period was brief. The court found that the relationship was illegal and did not merit legal protection.

The case was heard by a bench of Justices Kaushal Jayendra Thaker and Ajai Tyagi. They noted that while live-in relationships may be recognized by the Constitution, this particular petition aimed to seek the Court’s approval for a relationship that was against the law.

The petitioners had approached the High Court, requesting a writ of mandamus to prevent harassment by the woman’s husband and his family. According to the complaint, the woman had left her husband after he allegedly asked her to engage in inappropriate relationships with his friends.

The court observed that the duration of the couple’s cohabitation was not disclosed, and there was no evidence to show that her husband had threatened them. The bench stated, “The sequence of events indicates that the petitioner provided incorrect information, as no First Information Report (FIR) was filed.”

The court clarified that if the woman had genuine concerns or threats to her life, she could approach the police, who would take necessary action after verifying her claims.

As a result, the court dismissed the petition and imposed a cost of ₹5,000 on the petitioner for presenting misleading information.
