The Allahabad High Court has recently ordered a Central Bureau of Investigation (CBI) probe against a woman, Pooja Rawat, and her lawyer, Advocate Parmanand Gupta, for repeatedly filing false rape and other criminal cases to extort money from several individuals.
The Court observed that the woman and her lawyer were colluding to file false complaints with the aim of financial gain. This decision came while hearing a plea for protection from arrest filed by one of the accused individuals. The bench, comprising Justices Brij Raj Singh and Vivek Chaudhary, stated:
“Considering the seriousness of the allegations regarding multiple criminal complaints lodged by Pooja Rawat through her counsel Shri Parmanand Gupta against numerous individuals, we find it appropriate to direct the CBI to investigate the matter and submit its report.”
The issue surfaced when the petitioners approached the Court to quash a First Information Report (FIR) dated January 30. The FIR was filed under various sections of the Bharatiya Nyaya Sanhita (BNS) and Section 66D of the Information Technology Act. The petitioners also requested protection from arrest, coercive action, or inquiry against them.
The petitioners’ counsel argued that Pooja Rawat had a pattern of filing false complaints, noting that she had previously lodged 11 FIRs against multiple individuals, with the current FIR being her 12th. It was further claimed that all her complaints were filed through the same lawyer, Advocate Gupta.
The State counsel highlighted that similar cases had been filed under different offences, indicating a repeated pattern. He also noted that Gupta had filed numerous criminal cases and FIRs against various people.
After reviewing the facts, the Court remarked:
“It is evident that the informant and her counsel have colluded to file false FIRs against several people for serious offences to extract money. The present FIR appears to be part of this strategy to exert pressure.”
Consequently, the Court directed the CBI to investigate the matter and submit a report by April 10. It also provided protection from arrest to the petitioners until further notice.
This judgment highlights the judiciary’s strong stance against the misuse of legal provisions for personal gain and the importance of safeguarding individuals from false accusations.
