Allahabad High Court Acquits Man in Alleged Rape and Murder of 100-Year-Old Woman

The Allahabad High Court has acquitted a man who was earlier convicted of raping and killing a 100-year-old woman. The court found that the man was possibly falsely accused in order to claim government compensation.

The complaint was filed by the woman’s grandson, a Scheduled Caste member. He said the incident took place on the night of October 29, 2017, while his grandmother was sleeping in the veranda. He claimed he and his wife were inside the house when they heard her crying out. Upon checking, they saw the accused, allegedly drunk, lying on top of the elderly woman, trying to rape her.

He said the accused fled the scene when he tried to catch him. The elderly woman was taken to the hospital but died around 3:00 am. An FIR was filed shortly after, and the accused was charged with rape, murder, and offences under the SC/ST Act.

In 2020, the trial court convicted the accused and sentenced him to life imprisonment.

However, in his appeal, the accused’s lawyer argued that the case was false. He said the complainant had borrowed ₹1 lakh from the accused and filed the false case to avoid repaying the money and also to get financial help from the government due to their Scheduled Caste status.

The High Court noted several key problems in the prosecution’s case:

  • The accused’s clothes were not found at the scene, even though the witness said he fled naked.
  • No independent witnesses supported the allegations.
  • No injuries were found on the victim’s private parts to prove rape.
  • Medical reports showed the woman died from septicemia shock, not murder.

The court found these points raised serious doubts about the truth of the charges.

It also ruled that no caste-based crime had taken place, so charges under the SC/ST Act were not valid either.

The bench stated, “It seems the allegations may have been made only to claim government compensation.”

With this, the court acquitted the accused of all charges.
