Allahabad High Court Acquits Man in 100-Year-Old Woman’s Rape and Murder Case

The Allahabad High Court has acquitted a man accused of raping and murdering a 100-year-old woman, stating that he was falsely implicated and there was no solid evidence against him.

A Division Bench observed that the case may have been filed by the deceased woman’s grandson to gain government compensation under the Scheduled Caste category.

Case Background

The incident allegedly took place on October 29, 2017, when the victim’s grandson claimed he saw the accused assaulting his grandmother late at night.
The FIR was registered under Sections 458 and 376 IPC, along with SC/ST Act provisions. Later, charges of rape, murder, and criminal intimidation were added.
In November 2020, the trial court convicted the accused and sentenced him to life imprisonment.

Appeal in High Court

The accused challenged the conviction, arguing that:

The informant had borrowed ₹1 lakh from him and falsely implicated him to avoid repayment.
The false case was also used to claim government compensation.

High Court’s Observations

No clothes of the accused were recovered despite claims he fled naked.
No independent witnesses supported the allegations.
Medical examination showed no genital injuries on the victim, and her death was attributed to septicemia shock, not murder.
The Court also held that no caste-based offence was proved, making the SC/ST charges baseless.

Final Decision

The Court said the prosecution failed to prove the charges of rape and murder. It concluded that the allegations seemed to be made for monetary benefits.

The accused was therefore acquitted of all charges and ordered to be released immediately.
