Allahabad High Court: Women Face Challenges After Live-In Relationships End

The Allahabad High Court recently stated that women in live-in relationships face difficulties after a breakup, as Indian society still does not fully accept such relationships.

Court’s Observation on Live-In Relationships

The court made this remark on February 14 while hearing a bail application for a man accused of not fulfilling his promise to marry his live-in partner.

Granting bail to Aditya Raj Verma, Justice Siddharth noted that when a live-in relationship ends, the woman is often left with no choice but to file a case against her former partner.

The court stated:

“This case highlights the serious consequences of live-in relationships. It is difficult for a woman to live alone after a breakup since Indian society does not widely accept such relationships. As a result, many women are compelled to lodge FIRs against their partners.”

Case Background

The couple had been in a live-in relationship for over a year. The woman was previously married and had two children. Later, she entered into a relationship with the accused and became pregnant, but the man refused to marry her.

Following this, the woman filed an FIR against the accused, alleging that he had sent objectionable photographs to her ex-husband, causing further complications in her life.

Legal Charges and Court’s Decision

The accused was charged under IPC Sections 376 (rape) and 406 (criminal breach of trust).

His lawyer argued that:

  • The woman willingly entered the live-in relationship.
  • She was a major and understood the consequences.
  • There was no initial promise of marriage.
  • The accused had been in jail since November 22, with no prior criminal record.

After reviewing the case, the Allahabad High Court granted bail to the accused, considering all aspects, including the evidence and the severity of the charges.

This case sheds light on the social and legal challenges surrounding live-in relationships in India, highlighting the difficulties women face after such relationships end.
