Chhattisgarh High Court: Accusing Husband of Illicit Relation with His Mother Is Mental Cruelty
In a recent judgment, the Chhattisgarh High Court stated that a wife’s repeated allegations of her husband having an illicit relationship with his own mother amounts to mental cruelty. The court emphasized that such accusations damage the sacred bond between a mother and son.
The decision was made by a division bench consisting of Justice Goutam Bhaduri and Justice Sanjay S. Agrawal. They allowed the husband’s appeal and overturned a previous ruling by the family court, which had rejected his request for divorce.
The couple had married in May 2011. The husband claimed that his wife had become abusive toward him and his mother soon after their marriage. He also stated that she left him in December 2013 and filed a false complaint against him and his family under IPC Section 498A. However, all the accused were acquitted due to lack of evidence.
During the proceedings, the wife admitted to accusing her husband of having an illicit relationship with his mother. The court viewed this as a serious and false allegation that constituted mental cruelty.
While granting the divorce, the High Court also addressed the wife’s financial rights. It ordered a monthly maintenance amount of ₹35,000, to be deducted directly from the husband’s salary.
