“Find a Job for Yourself”: CJI Chandrachud Advises Woman to Consider Mutual Divorce
During the hearing of a matrimonial dispute transfer petition, Chief Justice of India (CJI) DY Chandrachud advised a couple to settle their case through divorce by mutual consent instead of engaging in a long legal battle.
The CJI emphasized that prolonged litigation in matrimonial disputes often benefits only lawyers while draining the couple emotionally and financially.
Asking the woman about her education, the Chief Justice was informed that she holds an MTech degree and a doctorate from a US university but is currently unemployed.
“You are so educated and you do not have a job. You must find a job for yourself,” CJI Chandrachud remarked, encouraging her to become financially independent.
The Chief Justice further said, “You can spend 10 years of life fighting the case. It will continue for years and only lawyers will make merry. Why don’t you both be reasonable and agree to divorce by mutual consent? Otherwise, there will be criminal complaints and more complications. If you agree, we can close the cases.”
Noting the irreparable breakdown of the marriage, he added that if the woman had been uneducated, the situation might have been different, but given her qualifications, she had opportunities to rebuild her life.
The advice underlined the Court’s concern about unnecessary prolonging of matrimonial disputes and stressed the practicality of mutual consent divorce for couples with no chance of reconciliation.
