Noida Custodial Death: Youth Accused in Rape Case Found Dead, Police Personnel Suspended

In a shocking incident in Noida, a 20-year-old youth accused in a rape and sexual harassment case was found dead in police custody. The victim, identified as Yogesh Kumar, worked at a bakery and lived on its premises.

According to reports, a female co-worker had filed a complaint a month and a half ago, alleging rape and sexual harassment. The complaint was forwarded to the Assistant Commissioner of Police by the Director General of Police headquarters in Lucknow. However, no FIR had been registered before Yogesh was taken in for questioning on Wednesday.

On Thursday morning, May 16, Yogesh was found hanging inside the Chipyana police post barracks. He was rushed to a nearby hospital but was declared dead. Police said that NHRC guidelines were being followed and an investigation was launched.

The victim’s brother, Jitendra, alleged that police officers demanded ₹5 lakh for his brother’s release. He claimed to have paid ₹53,000 but was not allowed to meet Yogesh. The next morning, he was informed that his brother had died in custody.

Jitendra also alleged that a previous workplace dispute with the complainant woman had been resolved by the manager, but she had continued to hold a grudge. He claimed she told him she would ensure Yogesh ended up in jail.

Following the incident, Police Commissioner Laxmi Singh ordered suspension of all personnel posted at the Chipyana police post (except two trainees) and initiated inquiries against senior officers, including the post in-charge, the Bisrakh police station in-charge, and the Assistant Commissioner of Police. A post-mortem will be conducted by a medical panel with videography.

When asked about bribery allegations, the Commissioner stated that no such charge was mentioned in the family’s written complaint but assured that the claims would also be investigated.

Meanwhile, on the basis of the family’s complaint, an FIR under Section 306 IPC (abetment of suicide) was registered against the woman who had accused Yogesh of rape.

Human rights activist Rajeev Kumar Sharma called the police action “unlawful,” stressing that custody without an FIR was a violation of procedure.

This custodial death has sparked outrage and raised serious questions about police accountability and custodial rights.
