Delhi High Court Rejects Sarvjeet Singh’s Plea for Inquiry Against Jasleen Kaur Over False Testimony

The Delhi High Court has dismissed a petition filed by Sarvjeet Singh asking for a criminal inquiry against Jasleen Kaur for allegedly giving false testimony during his 2015 sexual harassment case.

Kaur, a student of St. Stephen’s College at the time, had filed an FIR against Singh under Sections 354A and 509 of the IPC, accusing him of harassing her at a traffic signal in Tilak Nagar, Delhi.

Singh was acquitted in 2019 after the trial court gave him the benefit of doubt. He later filed a petition under Section 340 CrPC seeking legal action against Kaur for giving false evidence and making false accusations during the trial.

However, Justice Sudhir Kumar Jain upheld the trial court’s decision and rejected Singh’s plea. The court stated that an acquittal on benefit of doubt does not mean the complainant gave false testimony or committed a crime under Section 195 IPC.

The court added that although Singh may have suffered damage to his reputation due to media coverage, it was not enough to justify criminal proceedings under Section 340 CrPC.

Justice Jain acknowledged Singh’s concerns but said he still has the option to file a defamation case or take other legal action if he believes Kaur’s complaint harmed his image.

The court also clarified that minor contradictions or changes in a witness’s testimony do not give an accused person the right to seek criminal prosecution against the complainant.

In conclusion, the Delhi High Court dismissed Sarvjeet Singh’s petition, stating that the conditions for launching a criminal inquiry against Jasleen Kaur were not met.
