Karnataka HC: Asking Wife to Study or Get a Job Is Not Cruelty
The Karnataka High Court has said that if a husband asks or suggests that his wife should pursue further education or find a job, it cannot be treated as cruelty under law.
Justice Dr HB Prabhakara Sastry, while hearing a revision petition filed by Dr. Shashidhar Subbanna and his mother, set aside their conviction under Section 498-A IPC, Section 34 IPC, and Sections 3 & 4 of the Dowry Prohibition Act.
The case involved a couple living in the United States. The wife alleged that her husband asked her to continue her studies and take up a job to help with family expenses. The court found this request reasonable.
“It is unclear how suggesting someone gain more knowledge or pursue education could be seen as cruelty,” the court said.
The bench noted that both husband and wife were highly educated and had discussed their future together before marriage, including her plans for further studies and employment after moving to the US.
The complainant also claimed that on their first wedding night, her husband said he didn’t want a child for at least three years, until he completed his MS degree. His family, however, allegedly pressured her to conceive.
The court stated that such conversations are common between spouses, and planning about having children cannot be treated as harassment or cruelty.
Regarding the dowry allegations, the complainant said she gave ₹50,000 cash, a gold ring, and a Sherwani. But the court observed that her own brothers confirmed it was family custom to exchange valuables during marriage ceremonies.
“There’s no proof of extra dowry demands by the accused,” the bench added.
The court also questioned the lack of evidence. It noted that the wife was educated, had access to email and digital communication, and could have saved proof if there were real demands for additional dowry.
Further, the court noted that the husband earned over ₹10 lakhs annually while living in the US. Based on weak and unverified testimonies, the court found no solid proof of dowry demand or cruelty.
In conclusion, the court acquitted the husband and his mother, clearing them of all charges.
