Woman Sent to Judicial Custody in Assam for Filing False Rape FIR

Hailakandi, Assam — July 15: In a significant judgment, the Additional Sessions Judge in Hailakandi, Assam, ordered judicial custody for a woman who had filed a false rape FIR.

The woman had alleged that the accused entered her home and raped her, leading the police to register a case under Sections 448 and 376 of the Indian Penal Code (IPC). However, during the legal proceedings, it was found that her allegations were untrue.

Following the revelation, the court also registered a case against the woman under Sections 193 and 195 of the IPC for giving false evidence and making a fake declaration in court.

The accused told the court that the woman held a grudge against him due to a land dispute and used the rape allegation as a form of revenge.

In its statement, the court observed, “Rape is a serious crime. Society reacts strongly to such acts, and demands harsh punishment for the guilty. However, filing false cases not only harms innocent people but also damages the integrity of the legal system.”

The court emphasized that justice must be served fairly and that courts and police should not be used as tools of personal vengeance. “Anyone who misuses the legal process must face consequences. This helps discourage others in society from doing the same,” the judge said.

The Hailakandi police welcomed the decision, stating, “This judgment sends a strong message to those who try to misuse the legal and police system for settling personal disputes. It highlights the need to protect the justice system from being misused and wasting valuable resources.”
