The Supreme Court of India recently addressed a divorce petition filed by a Bengaluru couple, both software engineers, advising them to give their marriage a second chance. The court suggested that their busy schedules, with opposing work shifts, may have contributed to their marital issues.
A bench comprising Justices K M Joseph and B V Nagarathna noted, “Where is the time for marriage? Both of you are software engineers posted in Bengaluru. One works during the day and the other at night. You have no regret for divorce but regret for marriage. Why don’t you give the marriage a second chance?”
Justice Nagarathna also remarked that Bengaluru is not a place where divorces happen frequently and encouraged the couple to consider resolving their differences.
However, the counsels for both parties informed the bench that during the petition’s pendency, they were referred to the Supreme Court Mediation Centre to explore the possibility of reconciliation. Despite the mediation, the couple mutually agreed to part ways and decided to proceed with a divorce by mutual consent under Section 13B of the Hindu Marriage Act, 1955.
As part of the settlement, the husband agreed to pay a total sum of ₹12.51 lakh as permanent alimony to the wife. The Supreme Court noted in its order dated April 18 that the settlement was lawful and there were no legal impediments. The agreement and the application under Article 142 of the Constitution were taken on record.
“We have reviewed the settlement agreement and found it lawful. There is no obstacle to accepting the terms. Thus, we exercise our power under Article 142 and dissolve the marriage by a decree of divorce by mutual consent,” the court stated.
Additionally, the court quashed other pending proceedings filed by the couple in Rajasthan and Lucknow under the Dowry Prohibition Act, Domestic Violence Act, and other connected cases.
This case highlights the importance of mediation in resolving matrimonial disputes and ensuring that settlements are conducted lawfully and amicably.
