Delhi High Court Quashes FIR After Rs 74 Lakh Matrimonial Settlement
The Delhi High Court recently quashed an FIR under Section 377 of the Indian Penal Code (IPC) after a husband paid Rs 74 lakh as part of a full and final settlement with his wife. Justice Talwant Singh highlighted that in matrimonial cases, once disputes are resolved amicably, criminal charges can be set aside to allow both parties to move forward in life.
Settlement Agreement Details
The husband and wife reached an agreement in September last year to settle all claims. As part of the settlement:
- The husband paid Rs 74 lakh to the wife for Stridhan, child maintenance, and permanent alimony.
- The wife agreed to invest Rs 10 lakh from this amount in the name of their minor child until he becomes an adult.
- The child’s custody remained with the wife, who was named the sole custodian.
- The husband was allowed video calls or one-hour in-person meetings with the child on special occasions.
Court’s Remarks
The court also quashed charges under Section 354 IPC to ensure all disputes were fully resolved, allowing the parties to begin a fresh chapter in their lives.
Compliance and Closure
The bench emphasized that both parties must adhere to the settlement terms and their court undertakings. The plea was disposed of accordingly.
