The Karnataka High Court recently directed a husband to pay Rs 25,000 to his wife as litigation expenses. This will enable her to hire a lawyer and contest his petition seeking a divorce.
The couple, married on December 26, 2011, has two children. The husband filed for divorce under Sections 13(1)(i) and (ia) of the Hindu Marriage Act. In response, the wife requested Rs 75,000 under Section 24 of the Act to cover her legal fees.
The trial court rejected her request, suggesting she seek help from the District Legal Service Authority. Dissatisfied with this decision, the wife approached the Karnataka High Court, stating that her husband, who works as the Head of Human Resources with a monthly income exceeding Rs 80,000, is financially capable of covering her legal costs. The wife argued that she has no income and is solely responsible for their children.
Justice S.G. Pandit reviewed the case and acknowledged the wife’s financial need. While the court deemed the requested Rs 75,000 excessive, it directed the husband to pay Rs 25,000 towards her litigation expenses.
The High Court also instructed both parties to cooperate with the trial court to ensure a swift resolution of the divorce proceedings.
