The Bombay High Court has quashed a rape case under the condition that both the accused and the alleged victim undertake six months of social service. The court, led by Justice Prasanna B. Varale and Justice S. M. Modak, mandated that both parties provide community service every second and fourth Saturday for six months. They must also obtain certificates from their assigned institutions confirming satisfactory completion of the service.
The case originated in March 2020, when the alleged victim filed a complaint citing issues of compatibility and misunderstanding with the accused. However, in February 2022, she submitted a no-objection certificate (NOC) affidavit, stating that the complaint stemmed from personal disputes and had since been resolved.
According to her affidavit, the accused and the victim were once romantically involved with plans to marry. Over time, they realized they were incompatible and decided to part ways. This led to disagreements, during which the accused allegedly shared personal photographs with her family. In response, the victim filed the FIR in anger.
Later, the victim married someone else and started a new chapter in her life. Both parties agreed to move on, leading to a joint plea for quashing the case.
After reviewing the facts, the court granted their request. The accused was assigned to Baal Welfare Children Trust in Chembur, while the victim was directed to Maru Ghal, Gorai, Borivali (W), for their social service obligations.
This judgment highlights a unique approach to resolving disputes, focusing on reconciliation and community contribution.
