The Delhi High Court has upheld a divorce on the grounds of cruelty after ruling that constant verbal abuse by a wife towards her husband and his family amounts to mental cruelty. This decision came in response to an appeal filed by the wife, challenging a family court’s ruling in favor of her husband, who had sought divorce under Section 13(1)(i-a) of the Hindu Marriage Act.
A Bench of Justices Sanjeev Sachdeva and Vikas Mahajan stated that the repeated use of abusive language by the wife caused significant mental agony and suffering for the husband, which qualifies as cruelty. The Court emphasized that no one should be expected to endure continuous verbal abuse, upholding the lower court’s decree for divorce.
In her appeal, the wife argued that her husband was involved in an extramarital affair with a colleague. However, the Court noted that the husband had provided specific instances where the wife and her father had verbally attacked him and his family. The judges highlighted that every person has the right to live with dignity and that such derogatory language can deeply humiliate an individual.
The Court dismissed the wife’s claim that no specific dates or times of abuse were provided, stating that the repeated use of abusive words throughout the marriage made such details less significant. As a result, the Court rejected the wife’s appeal and upheld the divorce.
