Last week, the Madhya Pradesh High Court revised its earlier controversial judgment where it had noted that a rape convict was “kind enough” to spare the survivor’s life. The remark had stirred public outrage.
A bench consisting of Justices Subodh Abhyankar and Satyendra Kumar Singh, on October 18, reduced the life imprisonment of a rape convict to 20 years, citing that he did not take the survivor’s life. This controversial statement was met with significant backlash.
Following the public response, the court took the initiative on October 27 to amend the order. The court acknowledged that the phrase “kind enough” was a mistake.
In the updated order, the court clarified that the convict’s actions were deemed “demonic.” The new wording emphasized that the reduction in sentence was due to the absence of any additional physical harm inflicted on the victim.
The revised sentence now reads: “Considering the fact that he did not cause any further injury to the victim, the court believes that the life sentence can be reduced to 20 years of rigorous imprisonment.”
The judgment from October 18, which was passed after an appeal by Ramsingh, who had been convicted of raping a girl under twelve, was modified to remove the problematic language. The court relied heavily on the testimony of the prosecution witnesses and the medical evidence presented.
While the controversial statement was changed, the reduction of the life sentence to 20 years remained in place.
