The Kerala High Court has ruled that when a husband continuously compares his wife to other women and taunts her for not meeting his expectations, it amounts to mental cruelty, which is a legitimate reason for divorce.
This ruling was made by a bench comprising Justice Anil K Narendran and Justice CS Sudha on August 4. The court was hearing an appeal filed by a husband who challenged a family court’s decision to grant divorce based on his wife’s claim of cruelty.
The wife had accused her husband of frequently telling her that she was not as attractive as he expected and that she did not measure up to other women, including women his brother had considered for marriage. She also said he often compared her appearance unfavorably to others, making her feel inadequate.
In its judgment, the court stated, “The repeated taunts from the husband about the wife not meeting his expectations, along with comparisons to other women, undoubtedly constitute mental cruelty. No wife should be expected to endure such treatment.”
The court further added that while an irreparable breakdown of marriage alone may not be enough to justify divorce, the law must consider the circumstances in the interest of the parties involved and society. The court highlighted the importance of acknowledging marriages that cannot be saved. Recognizing this, the court upheld the family court’s decision to grant the wife a divorce.
