Madhya Pradesh High Court Denies Bail to Disabled Man for Refusing Marriage Due to Caste Differences

The Madhya Pradesh High Court recently denied bail to a disabled man accused of rape, who refused to marry a woman due to caste differences. The man had allegedly promised to marry the woman but later backed out because of their caste and a five-year age gap, which was a concern raised by his father.

Justice Vivek Agarwal, while hearing the case, expressed concern that caste and social divisions still play a significant role in relationships in the 21st century. The applicant had filed for bail a second time in the case, arguing that the woman was a consenting party, and they had stayed together in hotels on multiple occasions.

However, the prosecution argued that this was not merely a case of consensual pre-marital sex. Both the accused and the woman were differently abled, and the accused had lured her into a relationship with the false promise of marriage. After securing a job with the Defence Ministry, he refused to marry her.

The court noted that the man was fully aware of the age and caste differences before entering into the relationship. Given the woman’s vulnerable status, the court decided it was not the right time to grant bail.

The judge stated, “To ensure justice and protect the interests of a vulnerable witness, this is not the appropriate stage to extend bail to the applicant.”
