The Karnataka High Court recently ruled that private medical records, such as abortion reports, cannot be used to prove adultery. The Dharwad bench, led by Justice NS Sanjay Gowda, emphasized that using such records would undermine doctor-patient confidentiality and drag medical professionals into marital disputes.
The case involved a husband who wanted to summon a doctor to produce documents related to his wife’s abortion. He argued that these documents would prove his wife’s alleged infidelity. The wife contested this, claiming that her medical records are strictly private and cannot be accessed by her husband or anyone else.
Justice Gowda agreed with the wife, stating that medical records are confidential and their disclosure would violate the right to privacy guaranteed under Article 21 of the Indian Constitution. The judge noted that compelling a doctor to share such information should only be done for strong, compelling reasons, and generally when public interest is involved.
