A Delhi court has instructed a woman to pay ₹15 lakh to her former husband for defamation. Judge Sunil Beniwal of the Saket District Court determined that the ex-wife’s actions caused harm to her ex-husband and obstructed his career advancement.
According to the court’s order on July 29, the woman’s actions constituted libel, as evidenced by the emails and chat records presented by the plaintiff. These records were verified through an electronic evidence affidavit and were not disputed by the defendant.
The lawsuit was filed by the man against his ex-wife, seeking damages for defamation and for initiating malicious and baseless legal actions against him. The couple, married in 2001, had their marriage dissolved in 2021 under the Hindu Marriage Act, 1955, on grounds of cruelty.
The husband claimed that his ex-wife left their home in 2009 with their daughter and began filing false lawsuits against him and his family. He also accused her of preventing him from seeing their daughter and using defamatory language about him and his family in emails.
He further alleged that after their divorce, the ex-wife continued to defame him by sending emails to his elderly and ill maternal uncle, who was also his employer. The constant harassment led him to undergo a major surgery in March 2022, costing ₹6 lakh.
The ex-wife argued that the husband’s lawsuit was a false and malicious attempt to harass her. She also claimed that the suit was invalid due to being based on outdated chats from 2010 and emails from 2020.
However, the court found that the ex-wife had given contradictory statements and that the lawsuit was still within the allowable period. Consequently, the court ruled that she must pay ₹15 lakh in damages, plus 9 percent interest from the date the suit was filed until payment is completed.
