Serious Measures Needed Against False Cases Filed Against Husbands: Delhi High Court

On Tuesday, the Delhi High Court emphasized the importance of addressing false cases filed against husbands and their families to prevent damage to the social fabric. The court warned that allowing such actions could lead to further abuse of the legal system.

This statement was made during a case where a false report of a woman’s suicide led to charges of cruelty under dowry laws against her in-laws and husband. The woman, still alive, had given false information about her suicide, resulting in her husband’s arrest for alleged cruelty, abduction to murder, and violations of the Dowry Prohibition Act.

The husband’s mother later filed an FIR, claiming that the wife had conspired with her family to extort money by faking her disappearance and suicide. The woman’s brother then sought anticipatory bail from the high court in the related cheating and conspiracy FIR against him and his family.

However, the high court denied anticipatory bail due to the severity of the allegations and the fraudulent initiation of criminal proceedings under Section 364 (kidnapping or abduction in order to murder) IPC.

Justice Anoop Kumar Mendiratta stated, “The criminal proceedings were a gross abuse of the legal process. The implications of such actions were not fully considered by the petitioner, but the unwarranted detention of the woman’s husband destroyed any chance of settlement. The law was misused as a weapon rather than a shield by fabricating the incident of disappearance and suicide.”

The judge further noted, “A serious view is necessary to prevent the social fabric from being ruined by fabricated facts. Allowing false accusations against entire families in matrimonial disputes will lead to further misuse of the law.”

During this period, the woman was in contact with her family, while her husband remained in custody, complicating the situation further.
