Supreme Court: Grant Bail to Convicts Who Have Completed 10 Years of Sentence
On Thursday, the Supreme Court remarked that all convicts who have completed ten years of their sentences and whose appeals are not expected to be heard soon should be granted bail, unless there are specific reasons to deny it.
This observation came from the Bench of Justices SK Kaul and Abhay Sreenivas Oka while considering multiple pleas from life convicts with pending appeals in various High Courts.
During the hearing, the court suggested two steps for such cases:
- Convicts who have completed 10 years of their sentence should be released on bail unless there are compelling reasons against it.
- Convicts who have completed 14 years of their sentence should be identified and considered for premature release, regardless of whether their appeals are pending.
The court emphasized the need to declutter jails and urged that this process should begin immediately.
The High Courts and State Legal Service committees were given four months to implement this directive. The case is scheduled for review in the last week of January 2023 to ensure compliance.
The court clarified that these directions are applicable to all High Courts on a similar basis.
